    CONSTRUCTION SECTOR ENFORCEMENT DECLINING

    HSE prosecutions and notices issued reduce whilst ‘high fines’ fall

    Our provisional analysis of the HSE public register of prosecutions and notices suggest that formal enforcement by HSE Construction sector groups fell between 2011 and 2012.

    The register data reveals that:

      1. Prosecutions – number of breaches prosecuted reduced by 9%;
      2. Notices – number of prohibition and improvement notices issued fell by 16%; and
      3. Fines – number of breaches attracting a fine of greater than £20,000 dropped by 33%.

        The number of breaches prosecuted can be affected by minor changes in charging practice i.e. one case may be subject to a single HSW Act charge rather than a large number of offences under specific regulations.
