The Bournemouth Echo has reported that John Samtani, aged 60, has been ordered to pay £55k in fines and prosecution costs and £50k compensation to a man left permanently disabled during the unloading of marble tiles from a container.

He was sentenced at Dorchester Crown Court on 28th July 2010.  He was also ordered him to repay some £20k in legal aid following an investigation into his financial affairs.

He was given 12 months to pay and faces 18 months imprisonment if he fails to do so.

The injured man suffered multiple fractures and has undergone numerous surgical procedures. He now walks with the aid of a stick as a result of the accident at premises on Old Wareham Road, Poole in November 2006.

Blatant disregard for safety

Jeff Morley, Regulatory Manager at Borough of Poole said:

“The council aims to work with businesses to ensure the health and safety of their employees in a practical, cost-effective way. However, as in this case, where there is a blatant disregard of health and safety considerations, we will not hesitate to prosecute.

We are extremely pleased with the outcome of this case, as the severity of the punishment demonstrates how seriously the courts deem this offence.”

Samtani called the sentence “very harsh” and said that he would lodge an appeal.
