Telehandler driver denies manslaughter charge
The driver of a telescopic handler has pleaded not guilty to manslaughter by gross negligence of fellow workman on a construction site in September 2007. Nigel Herring denied the charge during a hearing at Plymouth Crown Court.
The trial is now scheduled for November 17 2009 and will be conducted by a visiting high court judge. It was agreed that the jury should visit a construction site to view operation of a telehandler of the type involved in the death.
Reece French, aged 20, died when he was struck by a falling skip on a Kier Group site in Plymouth. The Crown Prosecution Service (CPS) had earlier decided that Kier Western will not face corporate manslaughter charges and that no action is to be taken against any manager or foreman.
