Fatal accident inquiry says foreman put ‘lives at risk’
A Fatal Accident Inquiry (FAI) into the death of Kevin West in 2004 has highlighted a ‘glaring’ breach of health and safety. A foreman on the building site in Lanarkshire where Mr West died when a trench collapsed was said by the Sheriff to have “little regard” for safety.
The FAI findings have now been published and in his ruling Sheriff Douglas Brown has criticised the site foreman whom he said ignored a basic safety requirement and put lives at risk. The Sheriff also criticised the lack of “an effective system of supervision” which allowed the foreman to operate in the way he did. In 2007 construction company WH Malcolm were fined £100k after admitting breaching H&S legislation on the site.
Comment: This FAI report is well worth reading as it highlights the range of individual and corporate failings which ultimately produced the circumstances underlying this tragic death.
