PROSECUTION OVER DANGEROUS MACHINERY

Construction products manufacturer failed to maintain precautions

Kingspan Ltd, of Holywell, Flintshire has been ordered to pay over £5k in fines and prosecution costs after pleading guilty to an offence under Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998.

The prosecution comes after an incident in which an employee suffered serious injuries when he was pulled into a machine at a sheet steel-rolling plant. The injured workman was making drainage fall pipe components and feeding a sheet of steel into the machine when his gloved left hand became caught in the front rollers. His arm was crushed and sustained a double fracture. 

HSE inspector Paul Robinson said: “A metal guard for the front rollers had apparently previously been taken off to help line up the sheets to go into the machine. The company removed the rollers and fitted a new clear plastic guard immediately after the accident, but if the situation had been properly planned and controlled effective guarding would have been in place at all times.”
