PROSECUTION FALLING SKIP DOORS

Waste contractor fined after doors fell from rear-end-loading skip

F & R Cawley Ltd, of Luton, Bedfordshire has been ordered to pay over £8k in fines and prosecution costs after admitting breaching PUWER 1998 Regulation 5 1988 and the MHSW 1999 Regulation 5. The skip was raised and tipped to deposit the contents into the rear of a truck. Whilst this operation was being carried out the large metal doors at the rear of the skip became detached from the hinges and fell to the ground striking and the head of an employee. The skip doors had been removed and and not refitted securely during refurbishment of the skip. There was no monitoring system to ensure that this safety critical matter was checked before the skip left the workshop.

HSE Inspector Graham Tompkins said: “This was a foreseeable accident that had the potential to cause serious and even fatal injuries. It was easily preventable through simple communication and a basic monitoring system to ensure the safety critical instructions had been adhered too. “
